ORDER : The Court made the following order :- 1/3

The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 417, 376 and 506(i) IPC, in Crime No.18 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.This is the second petition for anticipatory bail. The earlier petition was dismissed by this Court on 14.07.2023, considering the grievous offence alleged against the petitioner. Now, seeking anticipatory bail this second petition has been filed.

3.The learned counsel for the petitioner would submit that if the DNA report shows the paternity of the petitioner, he is ready to marry the victim girl. Hence, prays to allow the petition.

4.The learned Additional Public prosecutor would submit that considering the grave allegations, custodial interrogation of the petitioner is very much needed in this case. Hence, prays to dismiss the petition. 5.Heard the learned counsel appearing on either side and perused the materials placed before this Court.

6.Considering the above facts and circumstances of the case, vehement objection raised by the learned Additional Public Prosecutor, this Court is of the view that if he is released on bail then he might hamper the investigation. Though the petitioner promise to marry the victim, considering the nature of grave offence, this 2/3

Court cannot encourage this kind of attitude.
