Mr.R.M.Anbunithi Additional Public Prosecutor (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.155 of 2023 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioners/Accused apprehend arrest at the hands of the respondent police for the offences under Sections 406, 465, 468, 471 and 420 of IPC in Crime No.155 of 2023, on the file of the respondent police, seek anticipatory bail. 1/3
2.The case of the prosecution is that the first accused was introduced by him in 2021 in Marthandam. At that time, he stated that he is having contact with so many politicians and higher officials. He also assured to arrange jobs in the Central Government Departments. He introduced the above said A1 to several persons including his relatives. From Several persons, several amounts have been deposited in the Bank Account of A1. In the course of time, the above said job arrangement was delayed. So, one the victims namely one Stem stated that he wanted to go to Canada. But he could not collect the money from A1. So, he arranged money through loan and paid the same to the above Stem. Totally, Rs.5,69,710/- was paid either in cash or through Bank transactions. They have also sent fake appointment orders. They joined in some of the posts.
But later, came to know that the above said postings are fake in nature. Upon which, a case in Crime No.155 of 2023, was registered for the offences under Sections 406, 465, 468, 471 and 420 of IPC. 3.Seeking anticipatory bail, this petition has been filed by the petitioners, stating that they have been falsely implicated in this case. 4.Learned Additional Public Prosecutor submitted that earlier petition of the petitioners seeking anticipatory bail was dismissed by this Court. This is the second petition before this Court. There is no change in circumstances. 5.Considering the gravity of the offence, the earlier petition was dismissed.
