Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.526 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(a) r/w 4 (1-A) of TNP Act in Crime No.526 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3

2.The case of the prosecution is that the accused persons were found in illegal possession of liquor bottles and when the police questioned about the same, the accused persons escaped from the scene of occurrence. Hence, the case. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he seeks anticipatory bail.

4.The learned Additional Public Prosecutor would submit that the accused persons were found in illegal possession of liquor bottles and when the police questioned about the same, they ran away from the scene of occurrence. Therefore, he objected to grant anticipatory bail to the petitioner. 5.Considering the facts and circumstances of the case and also considering the seriousness of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
