The Petitioner herein seeks a direction to the second respondent to cancel the patta issued to the 8th respondent in respect of the property in S.No.41/20 and S.No.41/22, Seriyalur 2/7
Jameen Village, Alangudi Taluk and Pudukottai District and restore the patta in Petitioner's name and further to direct the respondents 1 to 3 to remove the fencing put up by the 8th respondent in the property aforementioned and ensure access to the Petitioner's house.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.It is the case of the Petitioner that patta for the property situated in S.No.41/20 originally stood in the name of Petitioner and subsequently, the patta was transferred in the name of 8th respondent for a portion of the property without notice to the Petitioner. Therefore, the Petitioner submitted a representation before the first respondent on 12.09.2022 seeking cancellation of patta issued in the name of 8th respondent for restoration of patta in the name of the Petitioner.
4.The Petitioner who appeared in person confined his arguments as far as the property in S.No.41/20 alone. As far as second limb of the prayer in the Writ Petition seeking a direction to remove the fencing put up by the 8th respondent in the above mentioned property is concerned, the said relief cannot be 3/7
considered by the official respondents and it is for the Petitioner to work out his remedy before the competent Civil Court. As far as the first limb of prayer in the Writ Petition regarding cancellation of patta issued in the name of 8th respondent is concerned, without expressing any opinion on the merits of the matter, this Court directs the first respondent to forward the representation submitted by the Petitioner, dated 12.09.2022 to the second respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the second respondent shall consider the same and pass final orders on its own merits after giving reasonable opportunity of hearing to the Petitioner and 8th respondent within a period of 12weeks thereafter.
5.With the above directions, the Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
