Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents 4 and 5 to consider the petitioner's representation dated 15.08.2019 and 16.09.2019 for appropriate action in the light of the information given by the seventh respondent in Na.Ka.No.200/2019 dated 21.10.2019 within the period that may be stipulated by this Court. ORDER
[Order of the Court was made by T.S.SIVAGNANAM, J.] Heard Mr.K.Ponnaiah, learned counsel appearing for the petitioner and Mr.A.K.Baskara Pandian, learned Special Government Pleader, who accepts notice on behalf of the third respondent and Mrs.S.Srimathy, learned Special Government Pleader, who accepts notice of the respondents 1, 2 and 4 to 6. By consent on either side, this writ petition is taken up for final disposal at the stage of admission itself.
2. The petitioner by way of this writ petition styled as Public Interest Litigation has brought before this Court the pitiable condition of the seventh respondent School.
3. It is submitted that the School has been in existence for over 50 years. The students who had pursued education are now well placed in different position. However, the recent past for about five to seven years, because the teachers are not showing utmost interest and the Department is not taking care of the School, slowly the students strength has reduced. Apart from that the performance of the student is also not upto the mark.
4. All these issues have been pointed out and the petitioner and about 65 people in the village have submitted representations to the various authorities including the official respondents. These representations have been received by the office of the respondent on 30.09.2019 as could be seen from the postal acknowledgment card. If what has been stated by the petitioner is correct, then immediately proper steps should be taken by the Education Department and the issue should be addressed, because the petitioner states that majority of the student in the School belonging to Adidravidar community.
5. In the light of the above, we direct the sixth respondent to consider the representation of the petitioner dated 21.10.2019, inspect the School, take note of the deficiencies and the petitioner may also directed to be present, when the sixth respondent inspects the School. Upon inspection, the sixth respondent shall address all the issues and those issues, which should have to be addressed immediately, should be given top priority. This direction be complied with within a period of two weeks from the date of receipt of a copy of this order. 2/3
6. This writ petition is disposed of in the above lines. No costs.
