This Writ Petition is filed seeking a direction to forbear the respondents from laying the road in the petitioner's patta lands in S.No. 24/6A of Yerkudi Village, Madurai West Taluk, Madurai District without following the due process of law by considering the petitioner's representation dated 28.07.2022.

2. The grievance of the petitioner is that the 4th respondent made an attempt to lay a rod over the petitioner's patta property. Hence, the petitioner has filed this Writ Petition.

The learned Special Government Pleader appearing for the respondents would submit that there is 3 feet of common pathway for the purpose of free movement of the residents to enter into the main road. He would further submit that for the past 20 years, cement road was formed and now there is a proposal for laying paver block road. Since the petitioner has restricted for laying paver block road, the respondent stopped the said proposal. He has also produced the photographs in this regard.

4. Heard the learned counsel appearing on either side and perused the materials available on record..

5. On a perusal of the records, it is seen that in the village there is a common pathway of 3 feet, which was used for the purpose of free movement of the residents to enter the main road. Therefore, the petitioner cannot make any objection for laying paver block road. In the event, if the petitioner's land is taken over for laying road, it is upto him 3/6

to seek compensation and he cannot prevent the villagers from using the said pathway for their free movement to enter into the main road.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
