ORDER

The Criminal Original Petition has been filed, invoking Section 528 B.N.S.S., seeking orders to direct the learned Judicial Magistrate No.V, Madurai to number the unnumbered Cr.M.P.No. Of 2024 and dispose of the same within a time frame that may be fixed by this Court.

2. The learned counsel appearing for the petitioner would submit that since the police has not taken any action, the petitioner was constrained to file a petition under Section 156(3) Cr.P.C. on 24.07.2024, that the learned Magistrate has returned the petition for rectification of some defects and that the petitioner, after rectifying the same, has represented the petition on 10.09.2024 and thereafter the petition was neither taken on file nor returned.

Considering the submission made by the learned counsel appearing for the petitioner, the learned Judicial Magistrate No.V, Madurai is directed to take the petition filed under Section 156(3) Cr.P.C. on file, if it is otherwise in order within a period of three days from the date of receipt of a copy of this order and then to conclude the enquiry and dispose of the same within a period of one month thereafter.

4. With the above direction, this Criminal Original Petition stands disposed of.
