Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Directing the respondents to promote the petitioner as Lecturer in the Electronic and Communication Department in the 3rd respondent College as per G.O.Ms.No.2406 Education Department dated 31.10.1981 by considering the petitioner representation dated 5.6.2019 and subsequent reminder dt.26.7.2019. JUDGMENT

(Judgment of the Court was delivered by M.M.SUNDRESH, J.) The appellant sought for consideration of his representation for the purpose of promotion from being a non teaching staff to a https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.A.(MD)No.1534 of 2019 teaching staff in the existing vacancy in tune with the Government order in G.O.Ms.No.2406 Education Department dated 31.10.1981. As it was not considered, the writ petition came to be filed. The learned single Judge dismissed the writ petition stating that the said Government order is not applicable to the case of the appellant. Challenging the same, the appellant is before this Court with this writ appeal.

2.It would only be appropriate to leave the said issue to the second respondent. Therefore, we will call upon the respondent No.2 to consider the representations of the appellant dated 05.06.2019 and 26.07.2019 within eight weeks from the date of receipt of a copy of this judgment in accordance with the relevant Government order governing. In such view of the matter, the order of the learned single Judge stands set aside and the appeal stands disposed of. No costs.
