ORDER
This writ petition has been filed seeking a direction to respondents 1 and 2 not to grant patta in favour of the third respondent in respect of the property comprised in S.F.No.1883/1, situated at Vedachandur Village, Dindigul District, by considering the petitioner's representation dated 01.09.2023.
2. Heard the arguments of Mr.A.Arul Jenifer, learned counsel for the petitioner, Mr.A.Baskaran, learned Additional Government Pleader appearing for respondents 1 and 2, and Mr.S.Gokulraj, learned counsel for the third respondent.
3. According to the petitioner, the subject property is a public pathway used by the petitioner and others for accessing their properties. It is alleged that the third respondent is attempting to obtain patta in his name in respect of the said property. Therefore, the petitioner submitted a representation dated 01.09.2023, requesting the official respondents not to issue patta in favour of the third respondent in respect of the property situated in S.F.No.1883/1. Since the said representation has not been considered, the petitioner has approached this Court. 2/5
4. On the other hand, the learned counsel for the third respondent submitted that the subject property is not a public pathway, as claimed by the petitioner, and hence the request made by the petitioner is untenable in law.
5. In view of the rival contentions raised by the learned counsel for the petitioner and the learned counsel for the third respondent, this Court, without expressing any opinion on the merits of the matter, directs the second respondent to consider the petitioner's representation dated 01.09.2023 and pass final orders on its own merits within a period of twelve
(12) weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, the third respondent, and other interested parties.
6. With the above directions, this writ petition stands disposed of. No costs.
