Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to pay the balance amount of Rs. 37,94,934 (Rupees Thirty Seven Lakhs Ninety Four Thousand Nine Hundred and Thirty Four Only) to the petitioner, based on the petitioner's representation dated 03.09.2023. This Writ Petition is filed seeking a Mandamus as against the respondents to pay the balance amount of Rs.37,94,934 (Rupees Thirty Seven Lakhs Ninety Four Thousand Nine Hundred and Thirty Four Only) to the petitioner, based on the petitioner's representation dated 03.09.2023.
2. It is the case of the petitioner that he is a Class I contractor for PWD and Highways Department. The 1st respondent engaged the petitioner to fill up the land in various places to control the flood damage caused in various places due to incessant rains. Though 2/6
the petitioner has completed the works way back in the year 2021 itself, the petitioner has received a part bill of Rs.1.5 lakhs, but he has not received the balance amount of Rs.37,94,934/- till date. In this regard, the petitioner has also made a representation on 03.09.2023. However, till date the balance amount has not been disbursed to the petitioner. Hence, the petitioner has approached this Court with the aforesaid prayer.

The learned Government Advocate appearing for the respondents would submit that in the counter affidavit, the 1st respondent has admitted that the petitioner has not received the amount for the temporary restoration flood works and he seeks eight weeks time to disburse the balance amount to the petitioner.
4. In view of the above, this Court directs the respondents to pay the balance amount of Rs.37,94,934 (Rupees Thirty Seven Lakhs Ninety Four Thousand Nine Hundred and Thirty Four Only), to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
