Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, to direct the first respondent to conduct the land survey and to fix the four boundaries to the petitioner's land for an extent of 2.83 Hectare comprised in Survey Nos. 2921/3A1A2 and 3A1B situated at Genguvarpatti Revenue Village, Periyakulam Taluk, Theni District by considering the petitioner's application dated 14.06.2024 within the time to be stipulated by this Court.

ORDER

It is informed by Mr.P.Thambidurai, learned Government Advocate that a suit for partition in O.S.No.170 of 2024 has been filed on the file of the District Munsif cum Sessions Court, Theni against the petitioner and others in respect of the petition mentioned property, wherein the petitioner has been arrayed as the second defendant.

2. Considering the above, the prayer sought for by the petitioner in this writ petition cannot be granted. Accordingly, this Writ Petition is dismissed, however with liberty to the petitioner to renew his request after the disposal of the suit. No costs.
