ORDER : The Court made the following order :- The petitioner, who arrayed as accused No.1, was arrested and remanded to judicial custody on 26.08.2023 for the offences punishable under Sections 454, 457, 380 IPC @ 380 and 457 IPC in Crime No.375 of 2023 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner herein and other accused said to have broken the house of the defacto complainant and taken away a sum of Rs.1,95,000/-, gold ornaments and passport. Hence, the case.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. He would further submit that based on the confession of co-accused only the petitioner herein is arrayed as accused and his name is not found in the FIR and hence, he seeks bail.
4. The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner herein is having 15 previous cases in similar nature of offences and he is a habitual offender. He would further submit that the investigation of the case is pending and hence, he strongly opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the fact that the petitioner is having 15 previous cases, this Court is not inclined to grant bail to the petitioner.
