Mr.R.Sureshkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.06/2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners / accused apprehending arrest at the hands of the respondent 1/3

police for the offences punishable under sections 417, 420 and 120B IPC in Crime No.06 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioners have received a sum of Rs.1,43,00,000/- from the defacto complainant by saying as if they will purchase some lands and also make them as a partner in a petrol bulk. But, later, the defactco complainant came to know that there was no such petrol bulk and the lands also belong to the Government. Hence, the complaint.

3. The leaned counsel appearing for the petitioners would submit that due to the matrimonial dispute, a false case has been foisted against the petitioners. He would further submit that due to family dispute, already a complaint has been given against the petitioners and the same was registered in Crime no.526 of 2022 on the file of the Silaiman Police Station and seeks anticipatory bail.

4. The learned Government Advocate (Crl. Side) would submit that the petitioners have received a huge sum of Rs.1,43,00,000/- from the defacto complainant by saying as if they will purchase some lands and also make them as a partner in a petrol bulk. But, later, the defactco complainant came to know that there was no such petrol bulk and the lands also belong to the Government and now, the investigation of the case is pending and hence, he strongly, opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of offence committed by the petitioner and also submission made by the learned Government Advocate (Crl. Side) appearing for the respondent, this Court is not inclined to grant anticipatory bail to the petitioners.
