Respondent/ Defendant Civil Revision Petition filed under Article 227 of Constitution of India, seeking a direction to the Principal District Court, Dindigul, to dispose of the case in O.S.No. 287 of 2019 within the stipulated period .

PRAYER IN ORDER : This Civil Revision Petition coming up for orders on this day under the caption " Extension of time for Lower Court" and upon perusing the requisition letter submitted by the Principal District Judge, Dindigul, in D.No. 892/2023 dated 22.09.2023 seeking further extension of two months time to dispose the case in O.S.No. 287 of 2019 on the file the Principal District Court, Dindigul, this court made the following order:- "Today, this case is listed under the caption for "Extension of Time for Lower Court".

It is seen from the records that this Court, vide order dated 05.01.2023, has directed the learned Principal District Judge, Dindigul to dispose of the suit in O.S.No.287 of 2019 within a period of three months from the date of receipt of a copy of that order. Subsequently, at the request of the learned Principal District Judge, Dindigul, two months further time was granted vide order dated 15.06.2023.

Now the learned Principal District Judge, Dindigul has submitted another requisition dated 22.09.2023 stating that the arguments of both the sides were already over and that when the judgment was reserved, the defendant's side has filed a memo on 19.09.2023 stating that writ petition in W.P.(MD)No.18780 of 2019 is pending before the High Court and the case was adjourned for clarification.

The learned counsel appearing for the petitioner would submit that though the arguments were heard as earlier as on 10.04.2023, judgment was not pronounced by the then Principal District Judge, that arguments were again advanced before the present Principal District Judge and written arguments were already submitted, but the case was being adjourned again and again and that now since the other side has filed a memo stating that writ petition is pending, the case is being adjourned. would further submit that this Court has not granted stay in the writ petition as it was filed claiming mandamus to cancel the document.

Considering the above, the learned Principal District Judge, Dindigul is hereby directed to dispose of the suit in O.S.No.287 of 2019 within a period of six weeks from the date of receipt of a copy of this order as finally.
