PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus calling for the records relating to the proceedings of the respondents 1 to 3 in Office order No.2023-24/68, dated 26.09.2023 and its consequential impugned original order dated 27.09.2023 of the fourth respondent and quash the same as illegal and consequently directing the respondents 1 to 4 to permit the petitioner to continue his work as Chief Manager in State Bank of India RACPC, Tirunelveli.

The present Writ Petition has been filed by a Chief Manager of State Bank of India, who was working in a Tirunelveli Branch, challenging the order transferring him from Tirunelveli to Chennai. 2/6
2. According to the learned counsel appearing for the writ petitioner, his tenant had quarrelled with him and FIR has been lodged as against him in Tirunelveli. The said tenant had lodged a complaint to the higher officials of State Bank of India, for which, the writ petitioner has submitted an explanation and not being satisfied with the explanation, the Management has chosen to transfer him. Therefore, according to the learned counsel for the writ petitioner, the landlord and the tenant dispute is the reason for the transfer.
3. Per contra, the learned Standing Counsel appearing for the respondents 1 to 4 submits that the petitioner is holding a sensitive post. He was absent from 18.08.2023 to 18.09.2023 and reported for duty only on 19.09.2023. Though he has sent a leave letter on medical grounds, it was not accompanied with any proper medical certificate. The post is a very sensitive post and unless a regular Manager is appointed, it will be very difficult to deal with the customers. He further pointed out that on 11.09.2023 itself, the petitioner was informed about the transfer. The petitioner has not chosen to challenge the transfer of another person to his place on 11.09.2023, but only has chosen to challenge his order of transfer dated 27.09.2023. 3/6
4. From the above said deliberations, it is clear that the petitioner absented himself from 18.08.2023 to 18.09.2023 which prompted the Management to effect transfer on administrative grounds. This Court does not find any reason to interfere with the said order of transfer. In case, if the petitioner is aggrieved over his transfer, it is for him make representation to the concerned officials for effecting re-transfer to any other place as per his request.
5. With the above said observations, this writ petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
