O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to take necessary action to cancel Patta Nos.3012, 3013 and 1736 and to issue patta in the name of the petitioner in respect of the Natham lands bearing new Survey Nos.488/22, 488/23 and 488/24, situated at Vilachery Village, Madurai South Taluk, Madurai District, based on the petitioner's representation dated 22.05.2023, within a stipulated time to be fixed by this Court.

2. The case of the petitioner is that the petitioner's father owned certain properties, out of which two properties in Old S.No.366/7A2 (1408 sq. ft.) and Old S.No.366/7K2 (872 sq. ft.) were sold to the parents Page No. 2 of 6

of the third to seventh respondents. However, the patta was subsequently changed in the name of the mother of the private respondents in respect of lands comprised in Old S.No.366/7 (part), corresponding to New S.No. 488/22 in Patta No.3012, Old S.No.366/7 (part), corresponding to New S.No.488/23 in Patta No.3013, and Old S.No.366/7K2, corresponding to New S.No.488/24 in Patta No.1736, which originally belonged to the petitioner's father and had been settled in favour of the petitioners.

3. After the demise of the mother of the private respondents, the names of the petitioners were added in the said pattas. Therefore, the petitioner submitted representations to the first respondent, the second respondent and the Zonal Deputy Tahsildar. On 21.03.2023, the petitioner obtained information from the Tahsildar in Mu.Mu. No.153/2023/B under the Right to Information Act stating that no documents were available in the office relating to the proceedings for transfer of patta in respect of lands in S.Nos.488/22 and 488/23. This clearly shows that there were no proceedings for changing the patta.

4. On 14.03.2023, the District Revenue Officer, Madurai, directed the first respondent to take necessary action on the petitioner's petition. Page No. 3 of 6

Thereafter, on 29.03.2023, the first respondent directed the second respondent to take action on the petitioner's petition and the second respondent, in turn, directed the Zonal Deputy Tahsildar to take action. However, except for mere forwarding of the petitioner's petition from one authority to another, no substantive action has been taken. Therefore, the petitioner was constrained to approach this Court.

5. The learned Government Advocate appearing for the first and second respondents would submit that the petitioner's representation would be considered and appropriate orders would be passed by the first respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 22.05.2023 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the Page No. 4 of 6

petitioner, the private respondents and any other interested parties who may be affected by the decision. In the event of any rival claims, the same can be agitated before the competent civil court. There shall be no order as to costs.
