ORDER
Prelude:
"This dedicated bench is for implementing the pilot project to identify and dispose of criminal cases involving offences punishable with imprisonment up to 3 years pending at trial, appeal or revision stage for more than 3 years and also offences like Section like Section 506(ii) of IPC and others, which may carry a punishment of more than 3 years in the State of Tamil Nadu with reference to the 14 Districts coming under the Madurai Bench of Madras High Court."
2.This Dedicated Bench has taken the S.C.No.10050 of 2018 on the file of the I Additional District and Sessions Court, Madurai Taluk, Madurai, as Suo motu Special Tr.Case.(MD) No.7296 of 2025 in Suo Motu W.P.(Crl.).(MD).No.1014 of 2025, upon proper scrutinity and considering its suitability that it is a fit case warranting the exercise of power under Article 226 of Constitution of India to quash the said C.C., which is pending for more than Seven years without any progress. 3.Brief facts of the prosecution case in S.C.No.10050 of 2018: 2/5
According to the prosecution, on 05.05.2016, at about 02.00 p.m, the accused armed with deadly weapons, trespassed in to the newly constructed house site of the complainant and abused the complainant and others in filthy language and attacked them and caused injuries to them. Further, they damaged the newly constructed house, Bore well Motor and Electric Wire & Meter valued at Rs.72,750/-. Further, they threatened them with dire consequences stating that they do not make further construction work. Therefore, a case was registered in Crime No. 191 of 2016 for the offences punishable under Sections 147, 148, 294(b), 323, 506(ii) of IPC and 3 of TNPPDL Act. On investigation, final report has been filed and the same was taken cognizance in S.C.No.10050 of 2018 and the same is pending without trial for more than seven years. 4.
When the matter is taken up for hearing Mr.Ravi, the learned Additional Public Prosecutor, on instructions, would submit that Non Bailable Warrant was issued against all the accused and the same was executed and all the accused are produced before the I Additional District and Sessions Court, Madurai Taluk, Madurai.

Taluk, Madurai, is hereby directed to complete the trial in S.C.No.10050 of 2018, within a period of 2 months from the date of receipt of a copy of this order.
6.With the above said directions, this suo motu transfer petition stands closed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
