Heard both sides.

2. The petitioner challenges the impugned communication issued by the District Collector, Kanyakumari calling upon the Commissioner, Nagercoil Corporation to take appropriate steps for repairing the petition mentioned pryaer hall.

3. The learned counsel for the petitioner reiterated all the contentions set out in the affidavit filed in support of the writ petition.

4. When the matter was taken up for hearing, the learned Additional Government Pleader produced the copy of the communication from the RDO, Nagercoil in which it has been stated that the prayer hall in question was being run without getting any prior approval and since law and order issue has arisen, the question of recommending the proposal does not arise at all.
