ORDER : The Court made the following order :- The petitioner/Accused No.2, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC (Sand)in Crime 1/3

No.184 of 2023, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on 06.09.2023, at about 10.00 a.m., when the respondent police were on routine patrol duty, they found a tipper lorry in the agricultural land, which transporting 3 units of gravel stones worth about Rs.3,000/- illegally. Hence, the complaint.

3.On the ground that the petitioner was taking the above said stones for the purpose of blocking the water leakage, this petition has been filed. 4.The respondent police was present before this Court and had stated that the above said stones have been taken from Nedunkulam Kanmai area. Apart from that, he has also submitted that the petitioner is having one previous case, which is similar in nature registered in the year 2018. On that ground, the earlier petition filed by the petitioner was dismissed by this Court.

7.This is second application filed by the petitioner. Absolutely, I find no change of circumstances in this case.
