This Petition has been filed to withdraw H.M.O.P.No.269 of 2022, on the file of the Family Court, Thoothukudi and transfer the same to the file of the Subordinate Court, Sattur.

2. Despite service of notice on the respondent and his name is also printed in the cause list, there is no representation on behalf of the respondent. 1/4

In this petition, the petitioner seeks transfer of H.M.O.P.No.269 of 2022, filed by the respondent for dissolution of the marriage, pending on the file of the Family Court, Thoothukudi, to the file of the Subordinate Court, Sattur. The petitioner has filed H.M.O.P.No.128 of 2022 for restitution of conjugal rights before the Subordinate Court, Sattur.

Being satisfied with the reasons stated in the affidavit filed in support of the petition and in view of pendency of H.M.O.P.No.128 of 2022 filed by the petitioner before the Subordinate Court, Sattur, this Transfer Civil Miscellaneous Petition stands allowed. Accordingly, there shall be a direction to the learned Judge, Family Court, Thoothukudi, to transfer H.M.O.P.No.269 of 2022 to the Subordinate Court, Sattur, to be tried along with H.M.O.P.No.128 of 2022. The learned Subordinate Judge, Sattur, shall take steps to dispose of both the H.M.O.Ps. as expeditiously as possible, preferably within a period of 15 months from the date of receipt of a copy of this order.
