Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the respondents to forbear from cutting down the Nine Tamarind Trees situated in S.No.105 of Paraipatti Village, Vadipatti Taluk, Madurai District and consequently direct the respondents herein to receive annual taxes for the 2C Patta on the basis of the petitioner's representation dated 11.10.2022. ORDER
This Writ Petition has been filed to direct the respondents to forbear from cutting down the nine Tamarind Trees situated in S.No.105 of Paraipatti Village, Vadipatti Taluk, Madurai District and consequently direct the respondents to receive annual tax for the 2C Patta, on the basis of the petitioner's representation dated 11.10.2022.

The learned counsel appearing for the petitioner would submit that the petitioner has given a representation on 11.10.2022 to not cut down the nine Tamarind Trees situated in S.No.105 of Paraipatti Village, Vadipatti Taluk, Madurai District and to receive annual tax for 2C Patta. However, the same is yet to be considered. Hence, the Writ Petition. 2/5

The learned Special Government Pleader appearing for the respondents 1 to 5 would submit that the third respondent is the competent authority to consider the representation submitted by the petitioner. However, the petitioner has not submitted any representation to the third respondent. He therefore prayed for appropriate orders.

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the petitioner to submit a fresh representation to the third respondent in this regard within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the third respondent is directed to consider and dispose of the same, on its own merits and in accordance with law, within a period of eight (8) weeks thereafter.
5. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 09.01.2026 Speaking / Non-speaking order Index : Yes/No NCC : Yes/No mbi 3/5
