O R D E R

The petitioner herein seeks a direction to the respondents to consider his representation dated 04.10.2019, seeking reconveyance of the petitioner's land acquired by the second respondent.

2. Heard the arguments of M/s.P.Rohini, learned counsel for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents.

3. According to the petitioner, the property of the petitioner in S.No.556/9 in Eechantha Village, Oothankulam, Sankarankovil Taluk, Tirunelveli District was acquired by the respondents for providing access to burial ground. It is further stated that till date, the acquired property has been in possession and enjoyment of the petitioner and the same has not been utilised for the purpose for which it was acquired. Therefore, the petitioner submitted a representation on 04.10.2019, seeking reconveyance of the land. The said representation has not been 2/4

considered till date. Hence, the petitioner has come before this Court.

The learned Additional Government Pleader appearing for the respondents, based on written instructions, would submit that steps are being taken to utilise the land for the purpose for which it was acquired. The learned Additional Government Pleader would further submit that the representation submitted by the petitioner was dated 04.10.2019 and hence, the petitioner may be directed to submit a fresh representation.

In view of the same, without expressing any opinion, on the merits of the matter, the petitioner is directed to submit a fresh representation before first respondent within a period of four (4) weeks from the date of receipt of a copy of this order. On receipt of fresh representation, the first respondent shall consider the same and pass final orders on its own merits, within a further period of eight weeks.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
