RESPONDENT/RESPONDENT/DEFENDANT Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to allow this civil revision petition directing the Learned 6th Additional District Court, Madurai to expedite progress the E.P.No. 113 of 2019 in O.S.No. 177 of 2007 in an effective manner within a stipulated time as this Honourable Court.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.G.SHANKARAGANESH, Advocate for the petitioner, the Court made the following order:- By an order dated 20.12.2022, the above Civil Revision Petition was disposed of by this Court with the direction to the learned VI Additional District Judge, Madurai to dispose of E.P.No.113 of 2019 in O.S.No.177 of 2007 within a period of eight weeks from the date of receipt of a copy of the order.
2. The learned VI Additional District Judge, Madurai has sent a letter dated 20.06.2023 bearing reference D.No.366 to the Additional Registrar (Judicial) of this Court requesting for extension of time to dispose of E.P.No.113 of 2019 in O.S.No.177 of 2007. In the said letter dated 20.06.2023, the learned VI Additional District Judge, Madurai has given certain reasons for non-disposal of the E.P. which reads as under:- Further, I humbly submit that, the post of VI Additional District Judge, Madurai was kept vacant and I took charge as VI Additional District Judge, Madurai on the A.N. of 28.04.2023. After Completion of Vacation, I proceeded to dispose of E.P.No.113/2019.
Further I humbly submit that, after receiving copy of the order for the four hearing sale paper filed and same was returned due to rectification of defects. On 01.06.2023 Sale paper filed by plaintiff and the same is checked and issue sale Notice. The case is posted to 26.06.2023.
3. Considering the reasons given by the learned VI Additional District Judge, Madurai in the above letter, the time for disposing of E.P.No.113 of 2019 in
O.S.No.177 of 2007 is extended by another two months from the date of receipt of a copy of this order.
