This writ petition has been filed challenging the impugned order, dated 07.12.2020, passed by the second respondent, rejecting the petitioner's request to be appointed as a Cook on compassionate basis, on account of the death of his mother, who was a Noon-Meal Organizer.

The petitioner's request has been rejected by the respondents in view of the Government Order in G.O.Ms.No.48, Social Welfare and Women Rights (Sa.Na4-2) Department, dated 18.08.2021, which stipulates that only female members can seek for compassionate appointment to the post of Noon Meal Organiser / Cook. However, it is now brought to the notice of this Court by the learned Additional Government Pleader appearing for the respondents that by order dated 26.06.2024, passed by this Court in the Principal Seat in W.P.No.28231 of 2023, in the case of G.Karthikeyan vs. The Government of Tamil Nadu and others, the Government Order in G.O.Ms.No.48, Social Welfare and Women Rights (Sa.Na4-2) Department, dated 18.08.2021, has been declared to be illegal and the same has been quashed. In view of the same, the reason for rejection of the petitioner's request under the impugned order is not proper and therefore, the request of the petitioner for compassionate appointment to the post of Cook requires re-consideration.
3. For the foregoing reasons, the impugned order has to be quashed and the matter has to be remanded back to the very same respondent for fresh consideration of the petitioner's request for compassionate appointment to the post of Cook.

Accordingly, the impugned order, dated 07.12.2020, passed by the second respondent, is hereby quashed and this writ petition is disposed of by remanding the matter back to the second respondent for fresh consideration of the petitioner's request for compassionate appointment to the post of Cook in accordance with law by ignoring the Government Order in G.O.Ms.No.48, Social Welfare and Women Rights (Sa.Na4-2) Department, dated 18.08.2021, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
