This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to consider the petitioner's Page No. 1 of 5

representation dated 26.06.2023 and issue patta in the name of the petitioner and his brother, Vallinayagam, in respect of the property bearing Natham Survey No.1752/11, measuring an extent of 0.01.60 sq.m., i.e., 3 cents, situated at Keezha Surandai, Ayan Surandai Village,

The case of the petitioner is that the subject land bearing Natham Survey No.1752/11, measuring an extent of 0.01.60 sq.m., i.e., 3 cents, situated at Keezha Surandai, Ayan Surandai Village, Tenkasi District, was purchased by the petitioner's father on 28.04.2003. He was issued Natham Patta No.1544 and constructed a house thereon and has been paying all statutory taxes. Thereafter, the petitioner's father settled the said property in favour of the petitioner and his brother, namely, Vallinayagam, by a registered Settlement Deed dated 28.08.2019. Since the petitioner and his brother decided to demolish the dilapidated house and construct a new house thereon, the petitioner submitted a representation dated 26.06.2023 seeking issuance of patta in their names. As the said representation was not considered by the respondent, the petitioner was constrained to file the present Writ Petition.

3. The learned Special Government Pleader appearing for the respondent would submit that the petitioner's representation would be considered and appropriate orders would be passed by the respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondent to consider the petitioner's representation dated 26.06.2023 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be considered and disposed of after conducting an enquiry. The respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, his brother and any other interested parties who may be affected by the decision.
