PRAYER :- To release the petitioner on bail in the case in S.C No. 136/2023 on the file of the Assistant Sessions court, Sattur, Virudhunagar District in the case in Crime No. 162/2011 on the file of the respondent police pending investigation. 1/3

ORDER : The Court made the following order :- The petitioner/A6, who was arrested and remanded to judicial custody on on 01.03.2023 for the alleged offence punishable under Sections 457,397 of IPC in Crime No.162 of 2011, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 04.03.20211 at about 02.30 a.m., the petitioner along with other accused committed theft of 67 1⁄2 sovereigns of gold jewels and Rs.1,00,000/- cash at knife point from the bureau of house of the defacto complainant. Hence the case.

3. The learned counsel appearing for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is is custody from 01.03.2023, hence he seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that 8 similar previous cases are pending against the petitioner, hence, he strongly objected to grant bail to the petitioner.

5. Considering the facts and circumstances and also taking into consideration the previous bad antecedents of the petitioner this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
