Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus directing the second respondent to dispose the proceedings in Na.Ka.Ka5/3717/2017 regarding the land comprised in Survey Nos.93/10 and 93/11, V.M.Chatram Village, Palayamkottai Taluk, Tirunelveli District within a time to be stipulated by this Court.

ORDER

The petitioner, who has challenged the order of the third respondent rejecting his application for cancellation of patta had filed an appeal before the second respondent on 04.07.2016. After holding an enquiry on 02.03.2023, no further proceedings had taken place. Therefore, the petitioner has come forward with the present writ petition.

2. Taking into consideration the fact that an appeal, which is filed in 2016 has been enquired for the first time in the year 2023, and thereafter kept in cold storage by the second respondent, who is the authority competent before whom an appeal would lie and who has not acted on the same, a mandamus is issued to the second respondent to dispose of the same within a period of eight weeks from the date of receipt of a copy of this order.

3. With the above direction, this Writ Petition is allowed. There shall be no order as to costs.
