4. Manivel 5.Kanniappan ... Respondents Upon perusing the documents and case records of the above S.C.No.211 of 2020 transmitted to this Court and hearing the arguments of Mr.S.Ravi, learned Additional Public Prosecutor, on behalf of the State, this Court passed the following

ORDER

Prelude:

"This dedicated bench is for implementing the pilot project to identify and dispose of criminal cases involving offences punishable with imprisonment up to 3 years pending at trial, appeal or revision stage for 1/4

more than 3 years and also offences like Section like Section 506(ii) of IPC and others, which may carry a punishment of more than 3 years in the State of Tamil Nadu with reference to the 14 Districts coming under the Madurai Bench of Madras High Court."

2.This Dedicated Bench has taken the S.C.No.211 of 2020 on the file of the Principal District and Sessions Court, Madurai Taluk, Madurai, as Suo motu Special Tr.Case.(MD) No.7603 of 2025 in Suo Motu W.P.(Crl.).(MD).No.1014 of 2025, upon proper scrutinity and considering its suitability that it is a fit case warranting the exercise of power under Article 226 of Constitution of India to quash the said C.C., which is pending for more than five years without any progress. 3.Brief facts of the prosecution case in S.C.No.211 of 2020: According to the prosecution, the complainant is a Government Hospital Ambulance Driver. On 09.05.2015, at about 02.30 p.m, when the ambulance was coming on the road with dead body after completion of postmortem, the accused are said to have waylaid the ambulance and abused the complainant in filthy language and caused damage to the ambulance. Therefore, a case was registered in Crime No. 176 of 15 for the offences under Sections 147, 341, 294(b) IPC r/w 3 of TNPPDL Act. On investigation, final report has been filed and the same 2/4

was taken cognizance in S.C.No.211 of 2020, and the same is pending without trial for more than five years.

4.When the matter is taken up for hearing Mr.Ravi, the learned Additional Public Prosecutor, on instructions, would submit that Non Bailable Warrant was issued against all the accused and the same was executed and all the accused are produced before the Principal District and Sessions Court, Madurai Taluk, Madurai.

5.The Principal District and Sessions Court, Madurai Taluk, Madurai, is hereby directed to complete the trial in S.C.No.211 of 2020, within a period of 2 months from the date of receipt of a copy of this order. 6.With the above said directions, this suo motu transfer petition stands closed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
