O R D E R

This criminal original petition had been filed seeking a direction to the 1st Respondent to provide necessary police protection in pursuant to the petitioner's representation dated 07.11.2022. 2.The learned Counsel appearing for the Petitioner submits that the Respondents 4 and 5 had preferred a suit in O.S.No.92 of 2011 before the learned Additional District Munsif, Madurai Town and the same was dismissed. Against which, they had filed an Appeal before the learned Principal Subordinate Judge, Madurai, which was also dismissed. Subsequently, they preferred a Second Appeal before this Court, that was also dismissed. In spite of the same, the Respondents 3 to 17 had preferred a complaint against the Petitioner before the second Respondent. Further, he submits that the Petitioner himself had filed a petition in W.P(MD)No.101 of 2022 seeking to remove the 2/5

encroachment in Anthaneri Kanmai, Tallakulam Village, Madurai North Taluk, Madurai District, which was allowed by the Division Bench of this Court. The fourth Respondent is an Ex-Councillor of Madurai Corporation and at her instance only, the second Respondent had summoned the Petitioner. The Petitioner apprehends threat to his life and limb. The Respondents 3 to 17 belong to the same family and there had been several cases pending against them in Crime Nos.487 of 2010, 2117 of 2010, 2364 of 2010, 281 of 2011 and 208 of 2016.

3.The learned Additional Public Prosecutor submits that the second Respondent had registered CSR, where the Petitioner herein and the eighth Respondent attended enquiry.

4.In the light of the order passed in W.P(MD)No.101 of 2022, dated 28.10.2022, the Respondents 1 and 2 are directed to protect the life and limb of the petitioner in W.P(MD)No.101 of 2022 and also the Respondents 1 and 2 are directed to warn the Respondents 3 to 17 against any threat to the life and limb of the Petitioner, failing which, they will face the contempt of the order passed by the Division Bench of this Court.
