Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the 1st respondent in his proceedings in application No.2024/0105/25/151763, dated 11.03.2024 and quash the same as illegal and arbitrary and consequently to direct the 1st respondent to issue patta to the petitioner regarding the

property in S.No.371/2E, Koduvillarpatti Village, Theni Taluk, Theni in the name of R.Vimala, W/o.Late. Ramdass and to pass appropriate orders within a time frame to be fixed by this Court. For Petitioner :

ORDER

The petitioner is aggrieved by the fact that his request for survey and subdivision has been rejected without giving any reasons.

2. A perusal of the impugned order would show that the same simply reads as "rejected".

3. Heard the learned counsel on either side.

4. Considering the fact that the impugned order simply reads as "rejected", the same is set aside and the matter is remitted back to the first respondent. The first respondent is directed to dispose of the

petitioner's application for subdivision and transfer of patta and pass a speaking order within a period of six weeks from the date of receipt of a copy of this order.
