ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order in Doc.No.RFL/1 8/2022 dated 14.11.2022 issued by the 2nd respondent and consequently, direct the 2nd respondent to register the petitioners document in Doc.No.RFL/1 8/2022 dated 14.11.2022.
2.The contention of the petitioner is that the petitioner has purchased the land. When the petitioner submitted the sale deed before the 2nd respondent for registration, the respondent refused to register the same stating that it is temple land. Further, it is submitted that a case is pending before the Madras High Court in W.P.No.2903 of 2020 wherein the Court has held that the newly impleaded respondents are prohibited from registering any document with regard to the temple properties until further orders. The said submission is recorded. 3.When it is a temple land, the 2nd respondent is bound to conduct enquiry by calling the petitioner as well as the temple and then pass orders as per 2/4
the order passed in the case of Sudha Ravi Kumar and Another Vs. The Special Commissioner and Others in W.P.Nos.30589 of 2013 and batch, dated 05.04.2017.
4.Therefore, the 2nd respondent is directed to conduct an enquiry and pass orders in accordance to law.
5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
