This writ petition came up for settlement before the Lok Adalat. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement. AWARD The writ petitioner is the mother of one Arunkumar has filed this writ petition seeking compensation of Rs.25,00,000/- for the death of her son, who died due to electrocution, which according to the writ petitioner is due to the negligence of the Electricity Board officials, namely, the respondents 1 & 3.
Today, the learned Standing Counsel for the Electricity Board and Mr.K.Boopathy, Assistant Executive Engineer,TANGEDCO are present before this Court. Though the counsel for the petitioner is not present, the writ petitioner states that she is willing to receive a sum of Rs.5,00,000/- towards full and final settlement in terms of Board proceedings No.6, dated 16.10.2019. The respondent Board seeks four weeks time for payment of the compensation amount. Time is granted. The respondent Board shall make the payment directly to the petitioner within a period of four weeks from today. The court fee paid shall be refunded to the parties in the manner provided under the Court Fees Act 1870 as provided for under Sub Section 1 of Section 21 of the LSA Act, 1987, as amended in 1994.
The original of the award shall be placed in the Court record and copy of the award shall be kept with the High Court Legal Service Committee and one copy each is furnished to both parties free of cost.
In agreement of the above, both parties and their counsel have affixed their signatures/Thumb impressions in presence of the Lok Adalat Bench admitting the terms and conditions and accordingly, the award is passed. Amutha 2.The Superintending Engineer, Mannarpuram, Counsel for the Respondents This Lok Adalat award is passed in terms of the above settlement.
The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamilnadu Court Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
