ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 IPC r/w. 21(1) of Mines and Minerals (Development and Regulations) Act, 1957 in Crime No.208 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the defacto complainant was in 1/3

patrolling duty, the petitioner herein and other accused have illegally transported one unit of gravel sand. Hence the case.

3.The learned counsel for the petitioner would contend that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case, hence he seeks anticipatory bail.

4. The learned Government Advocate (Crl. Side) would submit that when the defacto complainant was in patrolling duty, the petitioner herein and other accused have illegally transported one unit of gravel sand he is having six previous cases in similar nature of offence and hence strongly objected to grant anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the serious nature of allegations made against the petitioner and that he is having six previous cases in similar nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
