Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondent No.1 to 3 to enquire the Panchami land which is situated in Survey No. 231, Unjampatti Village, Theni Taluk, Theni District and consequently take appropriate 1/4

action to restore the land which is allotted to the petitioner grandfather Late. Thiruman Mathari as Panchami land within a stipulated time period as prescribed by this Court.

ORDER

The petitioner seeks limited relief of a Writ of Mandamus to direct the respondents 1 to 3 to conduct an enquiry and restore the Panchami land, which were originally allotted to the petitioner's grandfather Thiruman Mathari.

2. The learned Additional Government Pleader appearing for the respondents would submit that though the petitioner has sought direction to the respondents 1 to 3, the competent authority would be the second respondent to consider the petitioner's representation for restoration of the Panchami lands. He would further submit that the lands as standing today are not classified as Panchami lands, but only as non Panchami lands. Therefore, he would submit that the petitioner's application would be dealt with on its own merits and in accordance with law. 2/4

In view of the above, the writ petition is disposed of, directing the second respondent to conclude the enquiry pending in Na.Ka.No. 187/2017/A3 and pass final orders on merits and in accordance with law, after affording an opportunity to the petitioner and any other interested parties, within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
