ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 294(b), 324, 506(ii) and 109 1/3

I.P.C, in Crime No.54 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 04.07.2023 at about 03.00 p.m., the accused persons came to the shop of the defacto complainant, abused and assaulted him with weapons, thereby, he sustained injuries in the hand and leg. They also threatened him with dire consequences. Hence, the complaint.

3. The learned counsel for the petitioners submitted that the petitioner is an innocent and not committed any such offence, as alleged by the prosecution. Due to previous motive, a false complaint has been foisted against them. Hence, prays to release them on anticipatory bail.

4.Earlier this petitioner has filed an application anticipatory along with coaccused. Considering the previous antecedents of this petitioner, that petition was dismissed in respect of this petitioner.

5.Without any change of circumstances, this petition has been filed. Since the petitioner is having one previous case, which is under section 302 of IPC, he is not entitled for any discretionary relief.
