ORDER : The Court made the following order :- The petitioner/accused who apprehends arrest at the hands of the respondent police for the offences punishable under sections 66(D) of the Information Technology Act, 2008 and Section 420 IPC equivalent to 318 of BNS Act in Crime No.49 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons collected huge amount of money from the public and they did not repay the amount. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and a false case has been foisted against him.

4. The learned Additional Public Prosecutor(Cri.Side) appearing for the respondent would submit that the petitioner along with other accused persons have committed fraud and they collected huge amount of money from the public through Whatsapp.

5. Considering the nature of allegations in this case that it is an online fraud and the amounts have been collected from the persons and further, the amount has 2/4

been withdrawn from the petitioner's account and the account has now been nil and further, the money trial has to be investigated, I am of the view that this is not a fit case for enlarging the petitioner on anticipatory bail.
