PRAYER :- For Bail in Crime No.318/2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused who was arrested and remanded to judicial custody on on 12.09.2023 for the alleged offence punishable under Sections 448,294(b) 506(2) of 1/3
IPC and Section 4 of TNPHW Act in Crime No.318 of 2023, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 11.09.2023 when the defacto complainant was alone in her house the petitioner herein trespassed into the house of the defacto complainant, pulled her saree and tries to misbehave with her and when she raised alarm her husband and neighbors came there and on seeing them the petitioner ran away abusing the defacto complainant in filthy language and also criminally intimidated her. Hence the case.
3. The learned counsel appearing for the petitioner would contend that the petitioner is innocent and due to previous enmity a false case has been foisted against him. He would further submit that the petitioner is is custody from 12.09.2023, hence he seeks bail.
4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that petitioner herein outraged the modesty of the defacto complainant, hence, he strongly objected to grant bail to the petitioner. 2/3
5.Taking into consideration the gravity of offence committed by the petitioner and also the fact that the investigation is in preliminary stage, this Court is not inclined to grant bail to the petitioner.
6. Hence the petition stands dismissed.
