Civil Revision Petition is filed under Article 227 of the Constitution of India to direct the learned District Munsif Cum Judicial Magistrate, Orathanadu, Thanjavur District to dispose the suit in O.S.No. 165 of 2023 on the file of the learned District Munsif Cum Judicial Magistrate, Orathanadu, Thanjavur District within the time stipulated by this Court.

ORDER

This Civil Revision Petition has been filed seeking a direction to dispose of the suit in to dispose the suit in O.S.No.165 of 2023 on the file of the learned District Munsif-Cum-Judicial Magistrate, Orathanadu, 1/4

Thanjavur District within the time stipulated by this Court.

2. Heard the learned counsel appearing for petitioner. Since the revision is filed for seeking early disposal, no notice is necessary to the respondents.

3. The learned counsel appearing for the revision petitioner / defendant submitted that the above said suit was filed in the year 2023 for permanent injunction and the same is being adjourned by the trial Court even after filing the written statement by the defendant without assigning any valid reason and therefore, the suit may be disposed of within the time stipulated by this Court.

4. Having been taken into consideration of the material facts and circumstances and that the suit is pending from the year 2023, this Court is of the view that in the interest of justice, a direction may be issued to the learned District Munsif-Cum-Judicial Magistrate, Orathanadu, Thanjavur District to dispose of suit as expeditiously as possible.

5. Accordingly, this Civil Revision Petition is disposed of with a 2/4

direction to the learned District Munsif-Cum-Judicial Magistrate, Orathanadu, Thanjavur District to dispose of the suit in O.S.No.165 of 2023 pending on his file within a period of six months from the date of receipt of a copy of this order on merits and in accordance with law. No costs.
