PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to shift the TASMAC retail shop no.7637 which is being run in a house just fifty meters away from the Salaigramam bus stand and TASMAC retail shop No.7638 which located right at the Salaigramam bus stand as per the proceedings of Respondent No.2 dated 02.09.2024 in Moo.Mu.T3/30081/2024 within the time stipulated by this Court. (Order of the Court was made by MOHAMMED SHAFFIQ, J) Petition is filed to shift TASMAC Shop Nos.7637 and 7638 pursuant to the proceedings Respondent No.2 dated 02.09.2024.
2. Learned counsel for the respondents, on instructions, would submit that sales in shops bearing Nos.7637 and 7638, would be stopped forthwith and further undertakes to remove the stocks and have the shops vacated by 31.10.2024. It was submitted that this is only in view of the fact that 30.10.2024 happens to be holiday. 2/5
3. Recording the same, petition is disposed of treating it as an undertaking given by the counsel for the respondent Nos.1,3 and 4. There shall be no order as to costs. Consequently, connected interim application also stands dismissed.
