For Respondent : Mr.R.M..Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No. 87 of 2023 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/accused No.1, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 420 and 506(1) IPC in Crime No. 87 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution as per the de-facto complainant is that the petitioner has received the amount of Rs.10,00,000/- from the defacto complainant by promising to get a job in the Tamil Nadu Electricity Board for the differently abled son of the defacto complainant. But the petitioner neither repaid the amount to the defacto complainant nor got him any job to the son of the defacto complainant. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and a false case has been foisted against him.
4. The learned Additional Public Prosecutor(Cri.Side) appearing for the respondent Police would submit that the investigation is going on.
5. Considering the nature of allegations that one Udhakumar, who has received the amount of Rs.10,00,000/- from the defacto complainant by promising to get a job in the Tamil Nadu Electricity Board for the differently abled son of the defacto complainant and the petitioner is the conduit between the said Udhayakumar and the defacto complainant, I am of the view that this is not a fit case for enlarging the petitioner on anticipatory bail.
