RESPONDENT / COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed by this Honble Court vide, Order Dated 16.1.2020, in Crl OP(MD) No.11383/2020, to deposit the original title deeds, not less then the value of Rs.1.50 Crores with the proper valuation certificate from authority concerned, to the credit of Crime No.

797 of 2020, before the Learned Judicial Magistrate No.V, Madurai, imposed upon the petitioner and consequentially to return back the title deeds to the petitioner. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S LAXMAN.K.R, Advocate for the petitioner and of MR.M.VEERANTHIRAN, Government Advocate(Crl.Side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed by this Court, vide order dated 16.10.2020 in Crl.O.P.(MD)No.11383 of 2020 to deposit the original title deeds, not less than the value of Rs.1.50 Crores with the proper valuation certificate from authority concerned, to the credit of Crime No.

797 of 2020, before the learned Judicial Magistrate No.V, Madurai imposed upon the petitioner and consequentially to return back the title deeds to the petitioner.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent.

3.Considering the facts and circumstances of the case, the condition already imposed on the petitioner in Para No.7 in Crl.O.P. (MD)No.11383 of 2020, dated 16.10.2020, is modified to the effect that "The petitioner is directed to deposit the original title deed stands in the name of his father, Kannan to the credit of Crime No.797 of 2020 before the learned Judicial Magistrate No.V, Madurai". Further, the learned Judicial Magistrate No.V., Madurai is directed to return the original title deed, which was earlier deposited to the credit of Crime No.797 of 2020, to the petitioner herein without filing any formal petition.

4.With the above direction, the Criminal Miscellaneous Petition is disposed of.
