ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.P.Ganapathi Subramaniam Advocate for the Petitioner and of Mr.C.Muthu Saravanan Advocate for the Sole Respondent and this Court made the following order:
Learned counsel for the respondent would submit that the revision petitioner remained ex parte before the trial Court and the case is posted for ex parte evidence.
2. The petitioner has to file appropriate application before the concerned Court. Only thereafter, he can move this Court for relief. The cause of action now sought before this Court does not survive.
3. With the above said liberty, this Civil Miscellaneous Petition stands disposed of.
