Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus direct the 2nd respondent to implement the order passed by the 1st respondent authority in his proceedings in No.O/967/2016 dated 26.12.2016 by conferring permanent status to the petitioner with continuity of service, back wages and all other attendant benefits within the period stipulated by this Hon'ble Court.

ORDER

This Contempt Petition is filed by the petitioner for non-compliance of the order passed by this Court in W.P.(MD) No.2360 of 2017, dated 29.03.2019, on the ground that the first respondent authority, in his proceedings dated 26.12.2016, already conferred the permanent status to the petitioner, however, the said order was not implemented and hence, this Court directed the contemnor/second respondent to implement the order of the first respondent and as against the non-compliance of the order, the present contempt petition is filed.

However, it is submitted by the learned Counsel appearing for the contemnor/second respondent that as against the order passed by the first respondent authority, dated 26.12.2016, the Management filed a writ petition in W.P.(MD)No.23190 of 2019 before this Court and also obtained interim order, on 07.04.2020 and the same was extended vide further order of this Court.

3. In view of the above, the Contempt Petition is closed. However, the petitioner is at liberty to canvass all those points in the writ petition filed by the Management.
