PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to include the names of the petitioners 2 and 3 in the service Register of his father Muniyandi as his legal heirs (Nominee) and issue Ward Quota Certificate to them, by considering the representation of the 1st petitioner dated 18.09.2024. O R D E R

The instant writ petition has been filed seeking a mandamus to include the name of the petitioners in the service register of their father Muniyandi as nominees and issue Ward Quota Certificate to them by considering the representation of the first petitioner dated 18.09.2024.

2. It is the case of the petitioners that the first petitioner's husband Muniayndi got married one Chandra and she passed away in the year 1997 leaving behind her two sons and a daughter. After the death of the first wife, the first petitioner is said to have married the said Muniyandi on 09.03.1998, 2/6

and the 2nd and 3rd petitioners were born to her through Muniyandi. The said Muniyandi had retired from his service as a Special Sub Inspector of Police on 30.07.2012.

3. According to the petitioners, as on today, in the service register of the said Muniyandi, the name of his first wife and the children born through his first wife alone are shown as nominees. Now, the grievance of the writ petitioners is that the name of the 2nd wife and the children born through the 2nd wife should be incorporated in the service register and thereafter Ward Quota Certificate to be issued to the writ petitioners. Seeking the said relief, the first petitioner has sent a representation to the respondents on 18.09.2024.

4. The learned Additional Government Pleader appearing for the respondents pointed out that along with the representation, no documents have been enclosed in order to verify the contentions of the writ petitioners.

5. In view of the above said facts, this court is inclined to pass the following orders :

i) The petitioners are directed to submit the death certificate of the first wife of the said Muniyandi namely Chandra and the proof of marriage of the first petitioner with Muniyandi.

ii) After issuing notice to Muniyandi, the respondent authorities are directed to consider the request of the petitioners and pass orders on merits in accordance with law. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of documents from the writ petitioners.

6. With the above said observations, this writ petition is disposed of. No costs.
