ORDER : The Court made the following order :- The petitioner, who is arrayed as accused, was arrested and remanded to Judicial Custody on 14.06.2023 for the offence 394 IPC @ Section 394 into Section 395 IPC in Crime No.164 of 2023, charge sheeted in SC.No.447 of 2023 on the file of the Principal Sessions Court at Thoothukudi, seeks bail.

2. The case of the prosecution is that on 15.05.2023, the petitioner along with other accused robbed 12 sovereign of gold chain from the defacto complainant at the point of aruval. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He further submitted that petitioner is in judicial custody from 14.06.2023 and seeks bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit the petitioner is having two previous cases in similar nature of offence and he is a habitual offender. Hence, he strongly objected to grant bail to the petitioner.

5. Considering the serious nature of allegations made against the petitioner and that he is having two previous cases in similar nature of offence, this Court is not inclined to grant bail to the petitioner. 2/3
