ORDER
By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.
2.The petitioner seeks a direction to the respondents to grant permission and provide necessary police protection to celebrate Arulmigu Sree Pandiyaraja Temple festival in every Tamil Karthigai and Chiththirai months as per the resolution of the committee by considering his representation dated 10.10.2024.
3.On perusal of the peace committee proceedings dated 08.12.2023, which is annexed in this Writ Petition, it is seen that the petitioner has already 2/4
filed a suit, in which the petitioner's right has been decided and peace committee meeting is also conducted in this regard. Now, the petitioner claims that new committee has been formed and some decisions have been taken to conduct the temple festival, for which, seeking police protection, he has filed this Writ Petition.
4.In such view of the matter, this Court is of the view that as the right has already been decided in the civil suit, as a matter of right, police protection cannot be sought for by the petitioner. Accordingly, this Writ Petition is dismissed. If at all any such protection is required, the petitioner is at liberty to move the concerned civil Court. No costs.
