Prayer in Crl.R.C.(MD)No.690 of 2021:- This Criminal Revision has been filed under Section 397 r/w 401 of Criminal Procedure Code, to call for records and to set aside the impugned "conditions No.3 and 6" made in the impugned order dated 24.08.2021 in Crl.M.P.No.1572 of 2021 before the learned Principal Sessions Judge, Ramanathapuram and consequently to return the petitioner's vehicle, namely Tractor bearing registration number 1/3
TN 65 AW 2848 and its Engine Number AZCSG72772653 & its Chasis number 3 and its Trailer to the petitioner forthwith. ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. M.S. Jeyakarthik, Advocate for the Petitioner and of Mr. S. Manikandan, Government Advocate (Crl.Side)for the respondents, this Court made the following order:
"This petition has been filed to modify the condition made in the order dated 28.09.2021 in Crl.R.C.(MD)No.690 of 2021 on the file of this Court and consequently, direct the Principal Sessions Judge, Ramanathapuram, to accept the certified copy of the Original R.C. Book.
2. The learned counsel for the petitioner submitted that the above said vehicle has been hypothecated to Shriram Finance Company. It was purchased on hire purchase agreement. Therefore, the original R.C.Book has been produced before the concerned company. So he is not in position to produce the same before the concerned trial Court. He requests to modify the above said condition.
3. Considering the above said fact, the condition to the effect that 'the petitioner shall produce the original R.C.Book before the trial Court' is modified to the effect that the petitioner shall file an undertaking affidavit to the effect that he will produce the Original R.C.Book after discharging of the above said loan. Consequently, two weeks time is granted for that purpose.
4. Accordingly, this petition is ordered."
