Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, to direct the 3rd Respondent herein to consider the various representations, the last one made vide No. SFPL/LD/24-25/015 dated 14.08.2024, in its correct perspective and effect appropriate name changes in the Revenue Records and issue a Patta in the name of the petitioner, with respect to the extent of 14.97 acres comprised in S.F.Nos.332/2A, 332/2B and 333/1, situated in Dombuchery Village, Bodinaickanoor Taluk, Theni District. ORDER

This writ petition has been filed for the following relief: "... directing the 3rd Respondent herein to consider the various representations, the last one made vide No.SFPL/LD/24-25/015 dated 14.08.2024, in its correct perspective and effect appropriate name changes in the Revenue Records and issue a Patta in the name of the petitioner, with respect to the extent of 14.97 acres comprised in S.F.Nos.332/2A, 332/2B and

333/1, situated in Dombuchery Village, Bodinaickanoor Taluk, Theni District ..."

2. The petitioner has purchased the property subject matter of this writ petition under two sale deeds dated 10.01.2022. They had initiated proceedings for mutation of the revenue records and for obtaining patta in their exclusive name. The applications had been made on 17.08.2022. Thereafter, online applications were made, since there was no progress to the earlier applications. However, the petitioner was surprised to be informed that their applications had been rejected by a one line order "litigation pending". The petitioner has not sought to challenge the said order, but has proceeded to file this writ petition for the relief set out supra.

3. Be that as it may, since the order of rejection is a non-speaking one line order, the same is set aside and remitted back to the third respondent who is directed to consider the applications of the petitioner and pass orders on their request for transfer of patta. In case, there is an objection, the objection shall be heard and thereafter, orders be passed.

The exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is allowed. No costs.
