Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the fourth respondent to provide the electricity service connection to the petitioner's house which is situated at S.No.839/1 & 2, Anbu Nagar, Panavilai, Sungankadai Post, Nagercoil, Kalkulam Taluk, Kanniyakumari District based on the petitioner's application No. 2000717511231160 dated 08.11.2023 within the stipulated period as fixed by this Court.

ORDER

By consent, this writ petition is taken up for final disposal at the admission stage itself.

2. Mr.S.Deenadhayalan, learned Standing Counsel, accepts notice on behalf of the respondents 1 to 4.

3. This writ petition has been filed seeking for a writ of mandamus directing the fourth respondent to provide the electricity service connection to the petitioner's house, which is situated at S.No.839/1 & 2, Page No.2/6

Anbu Nagar, Panavilai, Sungankadai Post, Nagercoil, Kalkulam Taluk, Kanniyakumari District, based on his application No.2000717511231160 dated 08.11.2023 within the stipulated period as fixed by this Court.

It is the case of the petitioner that he entered into the lease agreement dated 08.02.2016 with the receiver of the Arulmigu Chidhambara Vinayagar Kovil Trust/5th respondent herein in respect of the subject property. Thereafter, the petitioner constructed a house in the said property and he has also given application to the fourth respondent to provide electricity service connection to his house, however, no effective step has been taken so far. Hence, this petition. It is also stated that the fifth respondent has no objection to provide electricity service to the petitioner's house.

5. The learned Standing Counsel appearing for the respondents (TANGEDCO) would submit that if the petitioner produce NOC from the fifth respondent, they will provide electricity service connection to his house.

6. In view of the above submission, the petitioner is directed to get NOC from the fifth respondent and produce the same before the fourth respondent. On such NOC being made, the fourth respondent is directed to consider the application of the petitioner dated 08.11.2023 and effect electricity service connection to the petition mentioned house. Such exercise shall be completed within a period of one month from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. No costs.
