PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondents from preventing the petitioner's village people from utilizing the pathway situated in Natham land in S.No.2008/5 of D.Idayapatti Village (East) Village Group, Kadavur Taluk, Karur District for funeral processions en-route to the burial ground. ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) Today (07.07.2025) when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents 2 and 5, based on the written instructions from the Police Department, would submit that Peace Committee Meeting had been conducted between the parties and settlement had been arrived. He would further submit that the thar road is available to reach the burial ground and the dead bodies are not prevented from using the said road. Per 2/5
contra, the petitioner is attempting to take dead bodies through the temple, which may create some law and order problem in that locality. 2.In view of the said submission, we are of the considered view that since the thar road is already available and nobody is obstructing to use the thar road for taking dead bodies to reach the burial ground, no further consideration needs to be undertaken and all the villagers are expected to maintain peace and tranquillity in the village and use the thar road as provided by the revenue authorities in the subject locality.
3.With the above observations, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. (S.M.S., J.) & (A.D.M.C., J.) 07.07.2025 NCC : Yes / No Index : Yes / No Yuva 3/5
